Public Law and Disputation Between Online and Conventional Transportation in Legal Sociology Perspective (Case Study in Bandar Lampung)

Abstract

The increase of the population of in the big cities in various parts of the world, especially in developing countries, will further increase the problem of urban mobility (urban mobility). Gumilar Somantri said that currently more than 40% of the population live in urban areas that is expected to increase dramatically. The development of the transportation sector cannot be separated from the people life who use transportation itself. Various means of transportation such as two-wheeled, three-wheeled, four-wheeled vehicles, private vehicles, urban and rural transportation or expeditions such as trucks and tronton. Within the scope of this paper, only conventional and online-based transportation of people and goods. Considering that this transportation problem is still new and the legal umbrella has not completely regulated, it is not uncommon in various regions, especially in big cities in Indonesia, especially in Bandar Lampung. The problem is how to resolve online and conventional based transportation disputes; Also how to resolve transportation disputes through the sociological approach of Islamic law. The objectives of this research were:  to find out how to resolve online and conventional transportation disputes in Bandar Lampung; To find out how a sociological perspective of law can be an alternative non-litigation solution. The research method used an empirical juridical approach and data analysis used descriptive analysis to provide conclusions from this discussion. The results showed that online and conventional based transportation dispute resolution in Bandar Lampung (1). The solution is through deliberation or by kinship. The City Government, through the Transportation Agency, provides a way of mediation to resolve it, so that the transportation dispute does not enter the realm of the judiciary (2). Meanwhile, the solution through the legal sociology   approach is an alternative to resolve transportation disputes so as to achieve the legal objective of providing welfare and a sense of justice to the community.
