Fraudulent Online Shopping in Indonesian Law Perspective

Abstract

Online shopping is a new trend for people nowadays to sell and buy things easily. Online shopping as one of electronic commerce types is very known by people because it is paperless and face to face in doing its transaction. However, behind the convenience provided, the threat of fraud against online shopping activities is increasingly happening by using various digital platforms that apply today. The aim of this study is to elaborate fraudulent online shopping in Indonesian law perspective.

Materials and Methods:

The type of this study was empirical legal studies, which took sample 25 people out of 250 people. This study was shown percentages and it wasanalysed quantitatively.

Results:Out of 25 Online Shop buyers, 40% use Facebook, 28% use Instagram, 16% use WhatsApp, and 8% use ShopMedia and Shopee, while Media Lazada, Line and Twitterare not used in online transactions. Whereas out of 25 Online Shop Sellers, 60% use Facebook, 24% use WhatsApp, 8% use Instagram, 4% use Shopee and WhatsApp,  and 4% use WhatsApp and Facebook.

Conclusions:fraud occurring in online shopping mostly happen in Facebook both online shop buyers and sellers. However the victim of fraud tend to do not report to police  because of some reasons such as high administrative costs, time consuming, complex case handling procedures, the level of laziness in dealing with the police, and sincere of the victims.
