Abstract

The present study explores the existence of discriminatory menstrual customary practices which
perpetuates to deteriorate the menstrual health of women in India. The ‘Untouchability’ framework adopted
by Justice D.Y.Chandrachud in Sabrimala Temple case forms the backbone of this study. Apart from,
infringing right to health, these customary practices dominated by patriarchal outlook subjugate women to
biased attitudes, inequalities in social, economic and political life and inhuman treatment. The culture of
disgracing womanhood enforced by religions in India violates the constitutional rights and freedoms of
women in India. The study strikes at redefining feminism with the achievement of restoration of basic
human rights to women
